Clones

Licensees are not permitted to bring clones into Montana from out of state. Additionally, the “loop” won’t be open without receipts indicating the quantity and strain of seed the licensee wishes to enter into their inventory.

  • 16-12-203(3): Marijuana for use pursuant to this chapter must be cultivated and manufactured in Montana unless federal law allows for the interstate distribution of marijuana.

Zoning & Local Jurisdictions

Local jurisdictions retain the power to establish reasonable 'time, place, and manner' regulations via zoning, which can directly affect a licensee's operational eligibility.


Montana Clean Indoor Air Act – Required Signage for Businesses

The Montana Clean Indoor Air Act (CIAA), codified under Title 50, Chapter 40, Part 1, MCA, is a state law that prohibits smoking tobacco, marijuana, and e-cigarettes (vapes) in enclosed public place; it also protects the public and employees from the harmful effects of secondhand smoke in enclosed public places, including places of work.

The CIAA prohibits smoking tobacco, marijuana, and e-cigarettes (vapes) in enclosed public places.

Additionally, businesses must post signage in a conspicuous place at all public entrances to the establishment (in a manner that can be easily read and understood) that states that smoking in the enclosed public place is prohibited.

Business License - Relinquishment Process

The relinquishing licensee (seller) must submit the relinquishment in TAP. The seller will receive a Relinquishment Identification Number (RIN). The seller is responsible for providing the RIN to the party wishing to purchase the license being relinquished.

If the purchaser is an existing cannabis licensee, they must log into their TAP account to submit an application to either add a new license type or submit an update to add a site to their existing license type.

If the purchaser is not a current cannabis licensee, they must navigate to the TAP homepage and select 'Apply for or Manage a Cannabis Business License.’

The purchasing party must submit a complete application, including the selling party's Relinquishment Identification Number (RIN), processing fee, and all required documents within 10 calendar days or the relinquishment application may be denied.

The relinquishment application is dependent upon the purchasing party's successful application and will only be approved or denied in conjunction with their application. If the purchaser's application is successful, they will be issued a new license; the old license will cease immediately and can no longer operate.

If any subsequent transfer of products or plants to the new license is necessary as part of the sale, please contact your assigned inspector for assistance.


Compliance Testing & Remediation

Compliance testing failures require formal remediation within Metrc prior to any further activity, including: transporting, manufacturing, performing supplemental testing, and/or the creating of derivative child packages.


Updated Requirements for All Dispensaries – Effective 07/01/2026

Passed on May 8, 2025, and taking effect July 1, 2026, Montana House Bill 792 contains new requirements for all dispensaries.

Exit Package Requirements

Dispensaries must update exit packaging to include the revised warnings. These warnings must be placed next to the universal marijuana symbol. It also adds an addiction resource link (QR code) that must be printed on all exit packaging.

The updated warnings for the exit bags must be verbatim and printed in black ink against a white background.

  • WARNING: Consumption of marijuana may cause anxiety, agitation, paranoia, psychosis, and excessive vomiting.
  • WARNING: Consumption of marijuana by pregnant women may result in fetal injury and low birth weight.
  • WARNING: Consumption of marijuana by nursing mothers may result in infant hyperactivity and poor cognitive function.
  • WARNING: Driving while under the influence of marijuana is a crime.

Additionally, dispensaries must display new consumer education posters (at any point-of-sale) with the updated exit warning messages, the universal warning symbol, and the website address, phone number, and QR code for an available resource for overcoming marijuana addiction.

An administrative hearing will be convened to establish the regulations governing the educational posters and exit packages.


Ingestible-Infused Products: Maximum Serving Sizes – Effective 07/01/2026

Passed on May 8, 2025, and taking effect July 1, 2026, Montana House Bill 636 sets new maximum single serving size potency restrictions for marijuana-infused ingestible products.

In accordance with MCA 16-12-224, the maximum milligrams per serving package will be reduced from 10mg to 5mg of THC.

Packages created and labeled prior to July 1, 2026, may not be "sold through" after that date.

Licensees are responsible for ensuring all inventory is compliant before the deadline.
