Legislative Review

Are you curious if any new or amended laws were passed during Montana’s 2025 legislative session that will affect cannabis regulation?

Seven bills were passed that included regulatory additions, clarifying details, language related to licensing, deadlines, packaging and labeling, moratorium, and synthetic cannabinoids.

The following summary is a high-level overview only and is not an all-inclusive list of the laws. Once the bills are made law and the chapters are updated, all legislative changes will be available at MCA: Marijuana Regulation and Taxation. Read on for a summary of the changes and additions for each bill.

2025 Legislative Updates


Deadline to Apply for a New Licensed Location

SB 27 passed in the 2025 legislative session and is effective July 1, 2025. This bill “freezes the footprint” of the legal marijuana industry. As a result of this bill, the CCD will be accepting applications to add additional licensed locations until 7/1/25. Applications will need to be complete as of 6/30/25 in order to move forward. Any application not considered complete will be denied effective 7/1/25.

Per 42.39.107(5), the definition of a complete application is:

“An application is considered complete when the applicant or licensee, as applicable, has provided all statements, forms, diagrams, operation plans, and other applicable documents required in the application and has paid the nonrefundable processing fee…”

CCD strongly recommends that applications to add locations be submitted by June 20, 2025. This allows time for the TAP system to receive the completed application and the system to process the payment. Complete applications received by 7/1/25 will be issued a conditional license pending the completion of a successful inspection.

Administrative Recall Functionality in Metrc

On June 5, 2025, Metrc rolled out the Administrative Recall function, designed to provide users with additional transparency on a facility's package inventory status. Beyond the initial email notification to the facility Admin(s), the status is also identifiable in the following ways on the Packages Grid:

  • The package information will be displayed in blue.
  • The Administrative Recall (A.R.) column will display as “Yes” with a blue rectangle highlighting the text.
  • A banner will display notifying users that a package has been designated with the recalled status.

While users can transfer packages marked with this status, please note that packages under administrative recall cannot be combined, remediated, or submitted for additional lab testing.

Administrative Recall Functionality


Do Not Sell Products on Administrative Hold

If a product is placed on administrative hold, it must not be sold until the hold has been removed. An accidental sale due to a third-party POS system will be cited as a deficiency upon inspection. To prevent a third-party POS system from allowing the sale of a product on administrative hold, contact the POS company about setting up that restriction.
